These terms of use apply in the version valid at the time of the contract being concluded for use of the services offered via MEC Remote of Bosch Thermotechnik GmbH, Sophienstr. 30-32, 35576 Wetzlar ("Bosch", "we", "us") by you as a plant operator or service provider (referred to below as "User" or "You").
1. MEC Remote is a platform offering various functions, including plant overview, error messages, remote diagnostics function, access to relevant equipment documents, data records, as well as the graphic analysis and creation of status reports thereof, which can be made available to you in modules either free-of-charge or for a charge. Depending on the integrated plant, even the basic module can attract a charge.
The provisioned services include the making available of data for your customers and their plants, maps, information and other contents (referred to jointly as "Contents"), as well as the option to store and manage information and data on the customers and their plants in your profile.
The scope of the provisioned functions and services (referred to below as "Services") included in your provisioned module is stated in our service description at:

3. You are responsible for meeting the technical requirements (in particular hardware, web browser and Internet access) in your sphere of responsibility which are essential to contractual use of the services. We are not obliged to give any advice in this regard.
4. MEC Remote allows you to monitor customer plants on behalf of and with the consent of the end customer (plant owner), and/or to carry out a remote parameterisation. The prerequisite for linking a customer plant via MEC Remote is the express consent of your customer. You can use the attached master consent form for this purpose.
5. You are required to register in order to make use of the services. The self-registration for using MEC Remote is free-of-charge. However, we do reserve the right to offer certain or all services only for a fee. Any payable services are expressly identified as such. Detailed rules on using such services can be found in section 4.
There is no entitlement to uninterrupted use of free services. We do not guarantee that access to or use of MEC Remote will not be interrupted or impaired by maintenance work, further developments or otherwise, which may lead to loss of data. We aim to offer use of MEC Remote services with the least possible interruption. However, technical disruptions (such as interruption to the power supply, hardware and software faults, technical problems in the data lines) can cause temporary restrictions or interruptions.
For payable services (including those accessible under the usage relationship as defined by section 2, para. 3), we guarantee an annual average availability of 98% within our sphere of responsibility. The availability calculation does not include the regular MEC Remote maintenance window, which is every Monday between 00:00 and 6:00 hrs. CET. Interruptions that are beyond the control of Bosch are excluded, in particular those caused by force majeure

The services for Users can be used by all plant operators, plumbing, heating and air-conditioning specialists, contractors or hirers etc., insofar as they are entrepreneurs according to Section 14 BGB (German Civil Code). To register as a company with MEC Remote, you must name a contact person for the respective access. You are obliged to make sure, that the contact person has agreed to transfer its data to us. Minors and persons whose access authorization has been permanently blocked are not allowed to register. During the course of the registration process, you will be asked to provide information and specify your access data. This includes the following:

2. Any data (contact and payment data in particular) that have to be given during the registration process or during use of the provisioned services on MEC Remote must be given in full and correctly. If such data change during the course of the usage relationship, you must correct your data on MEC Remote in your personal settings immediately. If Bosch incurs costs on account of incorrect details (such as false postings due to incorrect account details), you are obliged to reimburse such costs.
3. In sending your registration data, you are offering to us to enter into a usage relationship (Use of MEC Remote – referred to below as "Usage relationship") based on these terms of use. When you receive the email confirmation, you will need to confirm activation of the requested access by clicking on the link contained in the email; a usage relationship as agreed will be formed only when you click on the link. Then we will activate the requested access. From the time of activation, you are entitled to use MEC Remote under these terms of use. If you fail to confirm within 30 minutes, you will not be able to activate your access via the link contained in the email. In this case, you will need to request access again.
4. Each plant, you can register for MEC Remote only once. Your registration, the usage relationship and the user account along with the access data are not transferrable.
5. You can terminate the usage relationship giving 4 weeks' notice by sending an email to:

We reserve the right to terminate the usage relationship either in full or for certain services giving four (4) weeks' notice.
6. If the usage relationship is terminated, your user name and password will be blocked within 5 working days from the effectiveness of the termination.
7. If your usage relationship is terminated, we shall be entitled to irrecoverable delete all data created for the purposes of your MEC Remote account after 30 calendar days from the effectiveness of the termination and after any statutory retention periods have expired. Personal data are governed primarily by the provisions on privacy, which can also stipulate a shorter period for deletion.
8. If you have additionally concluded with us a service contract in accordance with section 4, the right of either party to terminate the usage relationship shall be based on section 4.4.
1. You must keep your access data, including your password, confidential and must not disclose them to unauthorised third parties under any circumstances.
2. You are responsible for ensuring that only you and/or the persons you have authorised (e.g. your employees) have access to MEC Remote and use the services available on MEC Remote. If there is any concern that unauthorised third parties have obtained or will obtain knowledge of your access data, or if you are aware of any other illegal, improper, non-contractual or other unauthorised use of MEC Remote, Bosch must be informed immediately at the email address below:

You bear full responsibility for any use of and/or other activity on MEC Remote which is carried out through your access data. As the User, you are liable for any loss caused by unauthorised use by third parties, unless you are not responsible for the fault.
1. On MEC Remote, you can use payable services. Unless otherwise agreed in writing, if you book a payable service, a contract between you and Bosch for the booked service (referred to below as "Service contract") will be concluded, for which the following conditions apply.
2. The costs and payment terms for the individual services are provided in the service description (see link in Section 1, para. 2).
3. The service contract runs for a fixed term of 12 months from the activation date and will expire automatically at the end of the 12-month term. No termination is required. The service contract cannot be terminated ordinarily; the right to extraordinary termination for good cause remains unaffected. The service contract will not be extended automatically. For the service contract to be continued, it must be re-concluded. All fees stated in the service description (see link in Section 1, para. 2) are exclusive of VAT at the valid rate. Unless otherwise agreed, we shall charge you with the contractually due fee in accordance with the provisions of the payment terms stated in the service description. The amount will be billed electronically by sending the invoice via email. If you wish to have the invoice sent by post, you can request this by phone on 07153/306-1704. This will incur the postage and packaging costs stated in the service description.
4. If the service contract is not re-concluded, the use of any offered free services on MEC Remote under these terms of use is still possible.
1. Bosch shall be entitled to temporarily or permanently block your access to MEC Remote at its own discretion, either in full or for certain services, if there is clear evidence to suggest that you are contravening or have contravened these terms of use and/or the applicable law, or if we have any other legitimate interest in applying such a block. In the decision regarding a block, due consideration will be given to your legitimate interests.
2. In case of a temporary block, the access authorisation will be reactivated and you will be notified accordingly via email at the end of the blocked period, or when the reason for the block has been definitively eliminated. A permanently blocked access authorisation cannot be restored.
1. Your access authorisation is limited to access to MEC Remote and also to use of the services available on MEC Remote under these terms of use.
2. We point out that usage activities to the extent permitted by the Telemedia Act (Telemediengesetz) and the Federal Data Protection Act (Bundesdatenschutzgesetz) can be monitored, or we may be under a legal obligation in this respect. This can include the logging of IP connection data and the evaluation thereof if there is a specific reason to suggest a contravention against these terms of use and/or if there is a specific reason to suggest that any other illegal act or criminal offence has been committed.
The compilation of the contents on MEC Remote is, as such, proprietary. You are permitted to use such contents solely in accordance with these terms of use and to the extent specified on MEC Remote.
1. Unless further use is expressly permitted in these terms of use or on MEC Remote,
- You are permitted to download and display the contents available on MEC Remote solely for your own purposes. The transfer of the available contents to third parties is forbidden (see also Section 10). This right of use is limited to the period of your contractual participation on MEC Remote;
- You are forbidden from removing or altering copyright notices, logos and other symbols or protection notes.
2. You are entitled to download and print contents only to the extent that MEC Remote offers the functionality to download and/or print (e.g. via a download button).
3. You will receive an open-ended and non-exclusive right to use MEC Remote and/or the contents you have duly downloaded from MEC Remote for your own purposes. If the content has been made available to you for a charge, a further requirement for the granting of such a right is payment in full for the contents concerned. Moreover, all rights to the contents remain with the original right holder.
4. All intellectual property rights of Bosch to MEC Remote (including reproduction for private and other personal use in accordance with Section 53 Copyright Act (UrhG) shall remain unaffected.
Any action capable of impairing the smooth operation of MEC Remote, specifically of overloading our IT systems (e.g. by browser scripts or other programs) is forbidden.
1. Bosch quality standards include treating your personal data (referred to below as "personal data") in a responsible manner. Therefore, we collect, store and process the personal data arising from the registration for MEC Remote and from the use of the available services only to the extent required to use such services and to the extent permitted by law. We will treat the personal data as confidential and in accordance with the provisions of the applicable privacy law, and will not transfer such data to third parties without your express consent. Bosch will store the personal data for as long as you use the services provided by Bosch via MEC Remote. At the end of the period of use, the personal data will be deleted from MEC Remote.
2. Moreover, your personal data will be used only if you have given your express consent thereto. You can revoke the consent you have given at any time.

Bosch is liable to you without limitation solely for loss caused by an intentional or grossly negligent infringement of contractual obligations of Bosch, as well as for fatal injury, physical injury or injury to health. For a simple negligent breach of obligations, whose fulfilment mainly enables the proper performance of the contract and on whose compliance you can regularly rely (material contractual duties /cardinal obligations), the liability of Bosch is limited to foreseeable and typical loss. In all other cases, Bosch cannot be held liable. Any existing liability of Bosch in accordance with the Product Liability Act or in case of assuming of guarantees remains unaffected thereby.
2. The aforementioned liability limitations also apply for breach of obligations by the legal representatives or persons engaged by us in performance of our obligations. If, on the basis of the aforementioned provisions, a liability on the part of Bosch is excluded, this also applies to the personal liability for damages of our employees, representatives and of persons engaged by us in performance of our obligations.
Bosch reserves the right to change these terms of use at any time, including within the existing contractual relationships. You will be notified of such changes when you use MEC Remote. You have the option of consenting to the changed terms of use being integrated into the existing contractual relationship within 14 days of receiving the aforementioned notice. Otherwise, Bosch shall be entitled to extraordinary termination of the usage relationship and the service contracts within a further 14 days within immediate effect. You shall be entitled to continue using MEC Remote only if you consent to the currently valid terms of use.
Bosch reserves the right to continuously improve MEC Remote. This includes updates for product stability and functionality expansion.

3. If one of the provision of this General terms of use should be or become void or contestable or ineffective for any other reason, the other provisions of this General terms of use shall remain effective nonetheless. It is the express intention of the parties to uphold the validity of the remaining provisions in all cases case and, accordingly, to generally rule out the applicability of Section 139 German Civil Code (BGB). In such a case, the parties of this usage relationship undertake to replace the void, contestable or ineffective provision with one which comes closest to the original sense and guarantees corresponding economic success. The aforementioned likewise applies for closing any contractual loopholes.
4. Court of jurisdiction for all the litigations resulting from this agreement or in connection with this agreement will be Stuttgart, Germany.
Declaration of consent between end customer and User
I, _____________________ [name of end customer], __________________________________________ [address of end customer] consent to _________________________________ [name of User] managing my personal data via MEC Remote and receiving error messages on my plant via this portal. Consequently, perusal of the data by Bosch Thermotechnik GmbH is possible. I give my express consent to this. I can revoke this declaration vis-à-vis my User informally at any time. I can terminate the sending of data from my plant to MEC Remote at any time by interrupting the Internet access, disconnecting the LAN cable or resetting the web interface.
